Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and FitFam ("we", "us", or "our") and govern your use of the FitFam mobile application and the website at fit-fam-app.com (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service. If you participate in any paid challenge, you must additionally be old enough to enter into a legally binding contract and to make payments online in your jurisdiction.

2. Your Account

• You are responsible for maintaining the security of your Google account used to sign in.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate information and to keep your profile up to date.
• You may not impersonate another person or misrepresent your identity, workouts, or affiliation.

3. Acceptable Use

You agree not to:

• fabricate, falsify, or misrepresent workouts (manually, via HealthKit, or otherwise);
• use bots, scripts, or automation to log workouts or interact with the Service;
• upload content that is unlawful, threatening, harassing, defamatory, hateful, sexually explicit, or that infringes any third-party rights;
• use the Service to transmit spam, malware, or any harmful code;
• probe, scan, or test the vulnerability of the Service or attempt to circumvent any security measures;
• resell, sublicense, or commercially exploit the Service without our written permission.

We may remove content or suspend accounts that violate these Terms, at our sole discretion and without prior notice.

4. Challenges and Buy-Ins

4.1 How challenges work

A "challenge" is a time-bound competition within a group, with a configurable scoring system and an optional buy-in amount. The host of a challenge sets the rules. By joining a challenge you agree to those rules.

4.2 Payments

Buy-ins are processed by Stripe, Inc. By paying a buy-in, you authorize Stripe to charge your selected payment method. We do not store your full payment-card details. Stripe's terms and privacy policy apply to your use of their service.

4.3 Pot, fees, and payout

The "pot" for a challenge is the sum of all buy-ins paid by participants. FitFam may deduct a platform fee from the pot, which is disclosed at the time the challenge is created. The remainder of the pot is paid out to the winning participant(s) determined by the leaderboard at the end of the challenge, in accordance with the rules configured by the host.

4.4 Refunds

Buy-ins are non-refundable once a challenge has started, except as required by applicable law or where the challenge is cancelled by us due to a technical failure or violation of these Terms. If you believe a payout was incorrect, contact us within 14 days of the challenge end date.

4.5 Disputes between participants

FitFam is the operator of the platform but is not a party to disputes between participants over the legitimacy of workouts, scoring, or challenge outcomes. We may, at our discretion, void workouts, adjust leaderboards, or refund buy-ins where we have reasonable evidence of fraud, manipulation, or violation of these Terms.

4.6 Local law and gambling

You are responsible for ensuring that participating in a paid skill-based challenge is lawful in your jurisdiction. The Service is not available where prohibited by law. We may restrict or modify paid challenges in certain jurisdictions to comply with local rules.

5. Health and Fitness Disclaimer

FitFam is not a medical service and does not provide medical advice, diagnosis, or treatment. The information available in the Service, including workouts logged or imported from HealthKit and other sources, is for general informational and motivational purposes only.

Always consult a qualified healthcare professional before beginning any new exercise program. Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, or any symptoms of injury or illness. You assume all risk associated with physical activity you undertake while using the Service.

6. User Content

You retain ownership of the content you submit to the Service (workouts, photos, comments). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service and delivering it to other members of your groups and challenges.

You represent that you have all necessary rights to the content you submit and that it does not violate any third-party rights or laws.

7. Intellectual Property

The Service, including its software, design, branding, and content (other than your user content), is owned by FitFam and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Third-Party Services

The Service integrates with third-party services including Google Sign-In, Apple HealthKit, Stripe, the Apple Push Notification Service, and Oura. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

9. Termination

You may delete your account at any time from the Settings screen. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or if we discontinue any part of the Service. Upon termination, the licences granted to you by these Terms end. Sections that by their nature should survive termination (including ownership, indemnity, disclaimers, and limits of liability) will survive.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that the Service will meet your requirements or that the results obtained from using it will be accurate or reliable.

11. Limitation of Liability

To the maximum extent permitted by law, FitFam and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service.

Our aggregate liability for any claim relating to the Service is limited to the greater of (a) the total amount you paid us in the twelve months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars (USD 100).

12. Indemnification

You agree to indemnify and hold harmless FitFam and its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or any law.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You and FitFam agree to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, for any dispute that is not subject to arbitration or small-claims court.

14. Apple App Store Additional Terms

The following terms apply if you obtained the FitFam app from Apple's App Store. These Terms are between you and FitFam, not Apple. Apple is not responsible for the Service or its content. To the maximum extent permitted by law, Apple has no warranty or support obligations with respect to the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email. Your continued use of the Service after the new Terms take effect constitutes your acceptance of them.
